Sharks draw the line on foul play

In a move that goes even further than what I called for a week ago, the Sharks have passed a board resolution taking a firm “no tolerance” stance on acts of dirty pay on the field.

Speaking to The Mercury’s Mike Greenaway, Board Chair Stephen Saad revealed “we have decided that going forward there must be a policy of ‘no play, no pay’ should a player be suspended for foul play”. In other words, players handed bans due to on-field indiscretions would find their pay docked for the equivalent period of their suspension.

While this policy cannot, obviously, be applied retrospectively, the Sharks will ensure that the necessary clause to enable its enforcement will become a standard part of any new player contracts offered by the union.

Bloody good show, say I. I’m proud of the Sharks for standing up and taking action to improve our own standards, rather than whining about unfair treatment.

  • Is this saying it can not be enforced with the current crop of players and only those who sign contracts from here on out?

  • Well done Sharks. I wonder if other unions have similar internal punishment for their players? And if not, will they perhaps now be following the Sharks’ example?

  • @Dancing Bear (Comment 3) : My understanding is that the current crop of boneheads on suspension for punching, kicking etc cannot have their pay docked but if anyone else is stupid enough to punch, scratch, hairpull, kick etc then their pay will be docked for the length of their suspension.

  • I think they should get every player to sign an addendum to include this in their current contracts. If they don’t want to sign it then they don’t deserve to be playing rugby for a living.

  • @robdylan (Comment 18) : Why can’t SANZAR enforce this,if they can ban them why can’t it be without pay.Would stop repeat offenders like Horwill blatantly getting himself a couple weeks leave on full pay.

  • The union cannot force any player to add this clause to an existing contract- and very unlikely that guys on contracts and leaving soon will add this clause. Only newly signed guys will have this clause. So lets not get too excited. Its basically more for publicity than anything tangible

  • @VinChainSaw (Comment 21) : Let’s just clear a few things up first, how powerful a fart are we talking about here? I think your idea has potential as longs as metrics such as intention and harm factor radius can be accurately determined for every fart.

  • Doesn’t SANZAR or the Sharks have the right to fine their players? A fine equivalent to your salary for the matches you are suspended is essentially the same thing as forfeiting your match salary. This would not require a modification of the contract.

  • Also doesn’t pretty much every employment contract have a clause that states that if you represent your employer in a way that may damage the reputation of the employer etc.? Just wondering if a modification is really necessary, surely the Sharks have some authority to discipline their employees.

  • ooooohhhh platinum star nice, must be the slowest one to get here. :mrgreen: I have, in the past, had the authority to suspend an employee without pay from their employment because they used a company credit card to entertain customers at a strip club. That was not how the company wanted to represent themselves, and the employee was suspended without pay for 5 days, for acts that would damage the public reputation of the organization.

  • This is obviously mostly a good thing. I can see some negatives too. Some were already mentioned, like a player could get his pay docked and another wouldn’t because of when they signed their contracts. Another negative – if you are a player and you get offered a contract by the Sharks and the Stormers, you will earn the same amount for both contracts but the Shark’s contract has this clause in it. Which team would you join?

Yes I am in America, but my point was not the strip club or drinking at lunch specifically, but rather that every employment contract should have a clause authorizing the employer to discipline the employee if necessary. Discipline can include suspension without pay. My big question is why does there need to be a specific clause in their contract, if there is already a clause authorizing the employer to take disciplinary action against an employee. Just seems like good business practice no matter where in the world one might be.
